1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of fa1thwatches.com (the “Site”) and the purchase of any products or services offered by FA1TH Watch Co., operated by Flawless Minds LLC (“FA1TH,” “we,” “us,” or “our”). By accessing the Site, purchasing a product, or opting into our SMS or email programs, you agree to be bound by these Terms.

If you do not agree, do not use the Site or purchase products.

2. Company Information

FA1TH Watch Co. is a direct-to-consumer watch brand operated by Flawless Minds LLC, a limited liability company based in Savannah, Georgia, USA.

3. Eligibility

You must be at least 13 years old to purchase from FA1TH. If you are under 18, you represent that you have the permission of a parent or legal guardian to place an order, and that your parent or guardian has reviewed and accepted these Terms on your behalf.

By placing an order, you represent and warrant that all information you provide is accurate and complete and that you are authorized to use the payment method provided.

4. Products & Limited Editions

“The 1” — Limited Edition Collection

FA1TH’s flagship release, “The 1,” is a strictly limited edition of 100 units total (50 Black, 50 Silver). Sales are conducted on a first-come, first-served basis.

• Once a variant sells out, it will not be restocked.
• Orders are confirmed only upon successful payment capture.
• We reserve the right to limit quantities per customer to ensure fair distribution.
• Product images are representative; minor variations in color, finish, or packaging may occur and do not constitute a defect.

5. Orders & Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our sole discretion, including for suspected fraud, pricing errors, or insufficient inventory.

Payment

• We accept major credit/debit cards and other payment methods offered at checkout.
• Payment is captured at the time of order placement.
• You represent that any payment method used is yours or that you are authorized to use it.

Pricing

All prices are listed in US Dollars (USD) and do not include applicable sales tax, which will be calculated at checkout based on shipping destination. Prices are subject to change without notice.

6. Shipping & Delivery

• Processing time: Orders typically ship within 10–20 business days of order confirmation.
• Domestic shipping: US orders only at this time.
• Carrier: Orders ship via USPS, UPS, or FedEx with tracking provided by email.
• Risk of loss: Risk of loss and title pass to you upon our delivery to the carrier.
• Delivery delays: We are not responsible for delays caused by carriers, weather, customs, or other events outside our control.

7. Returns, Exchanges & Cancellations

Due to the limited-edition, collectible nature of our products:

• All sales are final. We do not accept returns or exchanges.
• Cancellations are accepted only if the order has not yet shipped. Contact hello@fa1thwatches.com immediately.
• Damaged or defective items: If your order arrives damaged or defective, contact us within 7 days of delivery with photo documentation. We will, at our discretion, replace the item, offer a repair, or issue a refund.
• Lost packages: If tracking shows delivery but the item was not received, you must report it within 7 days so we can open a carrier claim.

8. Warranty

FA1TH watches carry a six (6) month limited warranty from the date of delivery, covering defects in materials or manufacturing under normal use.

The warranty does not cover:

• Normal wear and tear, scratches, or cosmetic damage
• Damage from misuse, accident, water exposure beyond stated resistance, or unauthorized repair
• Battery replacement (if applicable)
• Loss or theft

9. Intellectual Property

All content on the Site — including the FA1TH name, logo, “The 1” branding, product designs, photography, graphics, copy, and code — is the property of Flawless Minds LLC or its licensors and is protected by US and international intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any content without our prior written permission.

10. User Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to bypass security, rate limits, or purchase restrictions
• Use bots, scrapers, or automated tools to place orders or access the Site
• Impersonate another person or misrepresent your information
• Interfere with or disrupt the Site or its infrastructure

11. SMS Marketing Program

FA1TH Watch Co. SMS Program

By providing your mobile phone number and checking the SMS consent box on our website form, you expressly consent to receive recurring automated marketing text messages from FA1TH Watch Co.

Program Terms

• Message Frequency: Up to 4 messages per month. Frequency may vary.
• Message & Data Rates: Message and data rates may apply based on your carrier and plan.
• Opt-Out: Reply STOP to any message to unsubscribe at any time. You will receive a one-time confirmation.
• Help: Reply HELP for assistance, or email hello@fa1thwatches.com.
• Consent Not Required: Consent to receive SMS marketing is not a condition of any purchase.
• Eligibility: You must be at least 13 years of age and a US resident. You confirm you are the authorized account holder of the mobile number provided.
• Carriers: Supported carriers include AT&T, Verizon, T-Mobile, and most US wireless providers. Carriers are not liable for delayed or undelivered messages.
• Data Handling: Mobile numbers and SMS opt-in data are never sold or shared with third parties for marketing. See our Privacy Policy for details.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FA1TH AND FLAWLESS MINDS LLC DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY PROVIDED IN SECTION 8 (WARRANTY).

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FA1TH AND FLAWLESS MINDS LLC, AND THEIR OFFICERS, EMPLOYEES, AND AGENTS, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless FA1TH, Flawless Minds LLC, and their officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your use of the Site, or your violation of any law or third-party right.

16. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of laws principles. Any disputes not subject to arbitration (see Section 17) shall be brought exclusively in the state or federal courts located in Chatham County, Georgia.

17. Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights.

Any dispute arising from these Terms or your use of the Site or products shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as noted below.

• Class Action Waiver: You agree to resolve disputes only on an individual basis and waive any right to participate in a class action, class arbitration, or representative proceeding.
• Exceptions: Either party may bring claims in small-claims court, or seek injunctive relief for intellectual property infringement, without arbitration.
• Opt-Out: You may opt out of this arbitration clause by emailing hello@fa1thwatches.com within 30 days of first agreeing to these Terms, with subject line “Arbitration Opt-Out.”

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email, SMS, or a notice on the Site. Continued use of the Site or placement of new orders after changes constitutes acceptance.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to be enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FA1TH regarding the Site and any purchase, superseding any prior agreements.
